associated "Readme.txt" file ("Documentation")

IMPORTANT -- READ CAREFULLY: By clicking the "Yes" button below and

continuing to use Ten Thumbs Typing Tutor("software"), you agree to be and

IMPORTANT -- READ CAREFULLY: By clicking the "Yes" button below and

continuing to use Ten Thumbs Typing Tutor("software"), you agree to be and

are hereby bound by the terms of this License Agreement ("Agreement"). By

clicking the "No" button below, you do not accept the terms of this License

Agreement and must destroy all copies of the Software and Documentation,

including this installer archive and any copies of it therewith.

I. GRANT OF LICENSE:

Runtime Revolution Ltd hereby grant you a non-exclusive license to use the

Software and Documentation subject to the following terms:

a) THE TRIAL VERSION

The software has been provided in a trial form ("Trial version").

You may: (i) use the Trial version for a period of ten days. (ii)

redistribute the Trial version to anyone in its original, unmodified form.

You may not: (i) Use the Trial version more than ten days after the date of

your first installing it on your computer. (ii) modify, translate, reverse

engineer, decompile, disassemble or create derivative works based upon the

Trial version or Documentation; (iii) resell, rent, lease, transfer, or

otherwise transfer rights to the Trial version or (iv) remove any

proprietary notices or labels on the Trial Version or Documentation.

b) THE FULL VERSION

If you pay for Trial Version you will be sent a key to unlock it. At this

time, the Software becomes fully functional ("Full Version").

You may: (i) use the Full version on any single computer; (ii) use the Full

version on a second computer so long as the first and second computers are

not used simultaneously; and (iii) copy the Full version for back-up,

archival purposes provided any copy must contain all of the original Full

Version's proprietary notices; (iv) continue to use the Full version without

the time restriction imposed on the Trial version above.

You may not: (i) permit other individuals to use the Full version except

under the terms listed above; (ii) modify, translate, reverse engineer,

decompile, disassemble or create derivative works based upon the Full

version or Documentation; (iii) copy the Full version or Documentation

(except for back- up purposes); (iv) resell, rent, lease, transfer, or

otherwise transfer rights to the Full version or Documentation; or (v)

remove any proprietary notices or labels on the Full version or

Documentation.

c) MULTI-USER VERSION

If you pay for a multi-user pack you will be sent a key to unlock the Trial

Version. The Software becomes fully functional ("Multi-User Version").

You may: (i) use the Multi-User Version on as many computers as stated in

the multi-user license purchased, independent from the number of users on

each computer; OR (ii) use the Multi-User Version with as many people as

stated in the multi-user license purchased, independent from the number of

computers used. In either case you may install the software on each

computer or over a network. You must choose whether to follow the terms of

clause (i) or (ii) when you install the software, and may not switch between

these two options or use one in conjunction with the other.

You may: (iii) copy the Multi-User Version for back-up, archival purposes

provided any copy must contain all of the original Multi-User Version's

proprietary notices; (iv) continue to use the Multi-User Version without the

time restriction imposed on the Trial version above.

You may not: (i) permit other individuals to use the Multi-User Version

except under the terms listed above; (ii) modify, translate, reverse

engineer, decompile, disassemble or create derivative works based upon the

Multi-User Version or Documentation; (iii) copy the Multi-User Version or

Documentation (except for back- up purposes); (iv) resell, rent, lease,

transfer, or otherwise transfer rights to the Multi-User Version or

Documentation; or (v) remove any proprietary notices or labels on the

Multi-User Version or Documentation.

II. VERSION:

This license does not grant you any right to any enhancement or update.

III. TITLE:

Title, ownership, rights, and intellectual property rights in and to the

Software and Documentation shall remain with Runtime Revolution Ltd. The

Software is protected by the copyright laws of the United Kingdom and

international copyright treaties.

IV. SONGSEEKER:

Lyrics searching capability is provided free and for personal use only.

This feature is subject to availability and may be withdrawn or altered at

any time. Lyrics are provided by searching the Internet, Runtime Revolution

Ltd. do not provide the content and are in no way responsible for anything

contained within the content, the content accuracy or any lack of content.

trademark of Apple Computer. Copyright of lyrics remains the property of

respective owners.

V. DISCLAIMER OF WARRANTY:

THE SOFTWARE AND DOCUMENTATION ARE PROVIDED AS IS WITHOUT WARRANTY OF ANY

KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Runtime Revolution

Ltd FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND

NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF

THE SOFTWARE AND DOCUMENTATION REMAINS WITH YOU. TO THE MAXIMUM EXTENT

PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RUNTIME REVOLUTION LTD BE

LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL,

PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION,

DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF

BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT

OR THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF RUNTIME REVOLUTION

LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME

STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY

FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY

TO YOU.

USING A COMPUTER AND KEYBOARD MAY CAUSE INJURY. IN NO EVENT SHALL RUNTIME

REVOLUTION LTD BE LIABLE FOR ANY INJURY, DISCOMFORT, OR OTHER INCONVENIENCE

CAUSED BY THE USE OF YOUR COMPUTER OR KEYBOARD.

VI. TERMINATION:

This license shall terminate automatically if you fail to comply with the

limitations described in this Agreement. No notice shall be required from

Runtime Revolution Ltd to effectuate such termination. On termination you

must destroy all copies of the Software and Documentation including this

installer archive and any copies of it therewith.

VII. ENTIRE AGREEMENT:

This Agreement constitutes the complete and exclusive agreement between

Runtime Revolution Ltd and you with respect to the subject matter hereof and

supersedes all prior oral or written understandings, communications or

agreements not specifically incorporated herein. This Agreement may not be

modified except in a writing duly signed by an authorized representative of

Runtime Revolution Ltd and you.
